Terms of Service

The rules of engagement for using the Certynd AI platform, APIs and services.

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the products, APIs, dashboards, integrations and any related services (collectively, the "Services") provided by Certynd AI ("Certynd", "we", "us"). By accessing or using the Services you agree to be bound by these Terms.

If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

2. Accounts

Certain features require an account. You are responsible for keeping your credentials secure, restricting access to your account and for all activities that occur under it. You must notify us immediately of any suspected unauthorized use.

  • You must be at least 18 years of age to create an account.
  • Account information must be accurate, current and complete.
  • Multi-factor authentication is recommended for all administrative users.

3. Acceptable use

You agree not to use the Services to:

  • Violate any applicable law, regulation or third-party rights.
  • Reverse engineer, disassemble or attempt to derive source code of the platform.
  • Interfere with, disrupt or place unreasonable load on the Services.
  • Use the Services to develop a competing product or benchmark without prior written consent.
  • Introduce malicious code, exploit vulnerabilities or attempt to bypass security controls.

4. Services and fees

Certynd offers subscription plans and usage-based pricing described on our pricing page. Fees are billed in advance and are non-refundable except where required by law.

We may change plans, pricing and features from time to time. Where changes materially affect a paid subscription, we will provide reasonable prior notice.

5. Intellectual property

Certynd retains all right, title and interest in and to the Services, including all software, models, dashboards, documentation and content, except for content you provide. You retain ownership of your data. You grant Certynd a limited license to process it solely to provide the Services.

6. Disclaimer

The Services are provided on an "as is" and "as available" basis. No security platform can guarantee the detection of every threat. Certynd disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, Certynd's total aggregate liability for any claims arising out of or related to these Terms or the Services shall not exceed the amounts paid by you to Certynd in the twelve (12) months preceding the event giving rise to the claim.

8. Termination

We may suspend or terminate your access to the Services if you materially breach these Terms. You may cancel your subscription at any time from within your account dashboard. Provisions that by their nature should survive termination shall so survive.

9. Governing law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. The exclusive jurisdiction for any dispute shall be the courts located in Toronto, Ontario.
